DUI/DWI in the Military
- If you are arrested for DUI/DWI while in the military, you can be prosecuted by the Judge Advocate General’s Office regardless of whether the event occurs on or off a military base
- You cannot be prosecuted by the military and the local government for the same offense
- The military reserves the right to charge you for any offense related to the initial charge, that is not part of the charges brought against you by a civilian court
- Punishments can include pay reduction and possible reduction in rank
- A military court martial can result in prison time and a dishonorable discharge
- You may also be barred from re-enlistment
- An administrative discharge can occur without a criminal conviction
- Under these circumstances, it is best to retain an attorney with prior military legal experience
