Imprisonment
A DUI/DWI conviction can sometimes lead to a prison sentence. The length of the sentence usually depends on the circumstances of the arrest
- First time offenders (non-aggravated) generally receive little to no prison time
- One may be placed on probation or sentenced to community service
- Repeat offenders will incur harsher penalties, likely receive a short prison sentence
- Aggravated DUI/DWI will carry more severe penalties
- Aggravated DUI/DWI is often dependent on BAC, and varies state to state
- Should an injury or fatality result from impaired driving, the penalties will increase dramatically. A prison sentence is virtually guaranteed in this case and depending on the circumstances, it will likely be of significant length
